Terms and conditions

1. General

• The photos on www.nikkiickx.be are only to be used by the owner, Nikki Ickx. Visitors to this site can view these photos but may not download or use these photos in any way or form without permission.

• Nikki Ickx Photography cannot be held accountable for material and/or immaterial damage during a photo session on location or in the home studio.

• Nikki Ickx Photography holds the right to change or augment the information on this website at any given time, including pricing and packages.

• Nikki Ickx Photography has the right at all times to stop a session or other service in case of lack of respect or violent behaviour (physical or verbal).

2. The home studio

• In or surrounding the home studio there may be a cat present. Nikki Ickx Photography is not liable for any allergies or damages related to this information.

• It is not permitted to take close up photos or videos of the settings or poses while the session is in progress. You may take some general behind the scenes photos where the photographer is included.

3. Sessions and products

• Nikki Ickx Photography is not responsible for providing a smaller selection gallery then usual when the photo session is due to special circumstances that are beyond the control of the photographer (for example: the weather, children who do not cooperate, instructions that are not followed, etc).

• Nikki Ickx Photography offers specialised photo products such as professional prints and wall art. When choosing to print your photos yourself or with another company, Nikki Ickx Photography does not offer any guarantee to the quality of the products.

• If you are unhappy with a pose or setup, please let me know during the photo session. This offers me the chance to rectify the problem. Complaints uttered after the end of the photo session will not be accepted if not mentioned during the session.

• Photos of a photo session or wedding are archived and kept for a minimum of 1 year after the date of the session or wedding. There is no guarantee to having a copy of your photos for more than 1 year.

• It is not possible to receive the RAW files or unedited photos after the photo session. Nikki Ickx Photography will deliver the chosen photos in JPEG or PNG format with the standard editing style that is shown in the portfolio.

• Because of the nature of the goods, it is not possible to return paid products or photos or to ask for a refund. The client is responsible for choosing and approving the final photos.

4. Copyright

• The copyright of the photos is always Nikki Ickx Photography's.

• The client gives Nikki Ickx Photography the permission to use the photos from photo sessions or weddings for commercial purposes (website, social media, business cards, flyers, albums, etc). If the client does not wish these photos to be used by Nikki Ickx Photography, the client should make this clear via email before booking a sessions.

• It is not permitted to alter the digital files in any way (incl. filters) than in the state they were delivered by Nikki Ickx Photography.

• When purchasing the digital files in high resolution the client has to right to reproduce these images for private use (for example prints or wall art). It is not permitted to use these files for publications for commercial or non-profit companies without express permission by Nikki Ickx Photography.

5. Prices, quotes and payments

• All quotes are without obligation if not expressly stated otherwise.

• All prices mentioned are in euros.

• A date will not be reserved without completing the booking process.

• Payment can be made through cash, bank transfer or via a banking app.

• If you are in default of payment, Nikki Ickx Photography reserves the right to suspend further execution of all current agreements between the parties until payment is made.

6. Cancellation policy

• Free cancellation is only possible in writing, via SMS, Whatsapp or email and at least 72 hours in advance for a photo session and 1 month for a wedding shoot.

• Canceling for a photo shoot at less than 72 hours before the photo session is only allowed in specific situations with a valid reason (illness, death of family member, etc).

• If cancellation occurs based on force majeure, Nikki Ickx Photography is not obligated to return any monies paid. Any reserved and paid for services that cannot take place due to force majeure will be rescheduled to a later date or the client will receive a voucher for the amount paid.

• Photo sessions always take place at a set time. If you are more than 15 late, without letting us know, this time will be deducted from the session. If you are more than 30 minutes late, the photo session will be cancelled without a refund of your deposit.

7. Gift certificates

• Gift certificates are personal and non-transferable.

• Gift certificates cannot be exchanged or redeemed for cash.

• The voucher represents the value at the time of issue. If there is a change in price after purchase before the voucher is redeemed, the difference must be paid in addition to the purchase price to be entitled to the service.

• Terms and conditions apply to all gifted photo sessions.

• Photo sessions take place based on availability in the calendar. Please contact us in time to schedule your photo session.
